Thanks for using our products and services (“Services”). The Services are provided by iMediaBank Inc. (“iMediaBank”)

By using our Services, you are agreeing to these terms. Please read them carefully.

Our Services are very diverse, so sometimes additional terms or product requirements (including age requirements) may apply. Additional terms will be available with the relevant Services, and those additional terms become part of your agreement with us if you use those Services.

Using our Services

You must follow any policies made available to you within the Services.

Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.

Our Services display some content that is not iMediaBank’s. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don’t assume that we do.

In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.

Your iMediaBank Account

You may need a iMediaBank Account in order to use some of our Services. You may create your own iMediaBank Account, or your iMediaBank Account may be assigned to you by an administrator, such as your employer or educational institution. If you are using a iMediaBank Account assigned to you by an administrator, different or additional terms may apply and your administrator may be able to access or disable your account.

Your Content in our Services

Some of our Services allow you to submit content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.

When you upload or otherwise submit content to our Services, you give iMediaBank (and those we work with) a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with our Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our Services, and to develop new ones. This license continues even if you stop using our Services (for example, for a business listing you have added to iMediaBank Maps). Some Services may offer you ways to access and remove content that has been provided to that Service. Also, in some of our Services, there are terms or settings that narrow the scope of our use of the content submitted in those Services. Make sure you have the necessary rights to grant us this license for any content that you submit to our Services.

You can find more information about how iMediaBank uses and stores content in the privacy policy or additional terms for particular Services. If you submit feedback or suggestions about our Services, we may use your feedback or suggestions without obligation to you.

About Software in our Services

When a Service requires or includes downloadable software, this software may update automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings.

iMediaBank gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you by iMediaBank as part of the Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by iMediaBank, in the manner permitted by these terms. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

Open source software is important to us. Some software used in our Services may be offered under an open source license that we will make available to you. There may be provisions in the open source license that expressly override some of these terms.

Modifying and Terminating our Services

We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.

You can stop using our Services at any time, although we’ll be sorry to see you go. iMediaBank may also stop providing Services to you, or add or create new limits to our Services at any time.

We believe that you own your data and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to get information out of that Service.

Our Warranties and Disclaimers

We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we don’t promise about our Services.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER iMediaBank NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTION OF THE SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICES “AS IS”.

SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.

Liability for our Services

WHEN PERMITTED BY LAW, iMediaBank, AND iMediaBank’S SUPPLIERS AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF iMediaBank, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIM UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICES AGAIN).

IN ALL CASES, iMediaBank, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

Business uses of our Services

If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify iMediaBank and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.

About these Terms

We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.

If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.

These terms control the relationship between iMediaBank and you. They do not create any third party beneficiary rights.

If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).

If it turns out that a particular term is not enforceable, this will not affect any other terms.

The laws of California, U.S.A., excluding California’s conflict of laws rules, will apply to any disputes arising out of or relating to these terms or the Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the federal or state courts of Santa Clara County, California, USA, and you and iMediaBank consent to personal jurisdiction in those courts.



How we collect information about you

When you visit the iMediaBank website or use the iMediaBank Services, we collect your IP address and standard web log information, such as your browser type and the pages you accessed on our website.

If you open an account, we collect the following types of information:

  • Contact information - your name, address, phone, email, Skype ID and other similar information.
  • Financial information - the bank account numbers and credit card numbers that you link to your iMediaBank account or give us when you use the iMediaBank Services.

Before permitting you to use the iMediaBank Services, we may require you to provide additional information we can use to verify your identity or address or manage risk, such as your date of birth, national ID number, Nationality, and other identifying information. We may also obtain information about you from third parties such as credit bureaus and identity verification services.

When you are using the iMediaBank Services, we collect information about your transactions and your other activities on our website or using the iMediaBank Services and we may collect information about your computer or other access device for fraud prevention purposes. 
 

How we use cookies

When you access our website, we, or companies we hire to track how our website is used, may place small data files called "cookies" on your computer.

We send a "session cookie" to your computer when you log in to your account or otherwise use the iMediaBank Services. How we protect and store personal information

Throughout this policy, we use the term "personal information" to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been anonymized so that it does not identify a specific user.

We store and process your personal information on our computers in the US and at various customer and operations support centers around the world such as in the Philippines, Ireland, Canada, and China, and we protect it by maintaining physical, electronic and procedural safeguards. We use computer safeguards such as firewalls and data encryption, we enforce physical access controls to our buildings and files, and we authorize access to personal information only for those employees who require it to fulfill their job responsibilities.

How we use the personal information we collect

Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience. To that end, we use your personal information to:

  • provide the services and customer support you request;
  • process transactions and send notices about your transactions
  • resolve disputes, collect fees, and troubleshoot problems;
  • prevent potentially prohibited or illegal activities, and enforce our User Agreement;
  • customize, measure, and improve our services and the content and layout of our website;
  • deliver targeted marketing, service update notices, and promotional offers based on your communication preferences;
  • compare information for accuracy and verify it with third parties.

Marketing

We do not sell or rent your personal information to third-parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. If you do not wish to receive marketing communications from us or participate in our ad-customization programs, simply indicate your preference by logging into your account going to the Profile subtab under the My Account tab and adjusting your preferences or by following the directions provided with the communication or advertisement.

How we share personal information with other iMediaBank users

To process your payments, we need to share some of your personal information with the person or company that you are paying or is paying you. Your contact information, date of sign-up, the number of payments you have received from verified iMediaBank users, and whether you have verified control of a bank account are provided to other iMediaBank users who you transact with through iMediaBank. In addition, this and other information may also be shared with third parties when you use these third parties to access iMediaBank services. Unless you agreed to it, these third parties are not allowed to use this information for any other purpose other than to enable the iMediaBank Services.

If you are buying goods or services and pay through iMediaBank, we may also provide the seller with your confirmed credit card billing address to help complete your transaction with the seller. The seller is not allowed to use this information to market their services to you unless you have agreed to it.

We work with third parties, including merchants to enable them to accept or facilitate payments from or to you using iMediaBank. In doing so, a third party may share information about you with us, such as your email address or mobile phone number, when a payment is sent to you or, when you attempt to pay that merchant or through that third party. We use this information to confirm to that you are a iMediaBank customer and that iMediaBank as a form of payment can be enabled, or where a payment is sent to you to send you notification that you have received a payment . 

Regardless, we will not disclose your credit card number or bank account number to anyone you have paid or who has paid you through iMediaBank or with the third parties that offer or use the iMediaBank Services, except with your express permission or if we are required to do so to comply with credit card association rules, a valid regulatory or law enforcement request, or, to cooperate in an ongoing law enforcement investigation, as otherwise required by law.

How we share personal information with other parties

We may share your personal information with:.

  • Service providers under contract who help with parts of our business operations; (fraud prevention, collection activities, marketing, technology services). Our contracts dictate that these service providers only use your information in connection with the services they perform for us and not for their own benefit.
  • Companies that we plan to merge with or be acquired by. (Should such a combination occur, we will require that the new combined entity follow this privacy policy with respect to your personal information. If your personal information could be used contrary to this policy, you will receive prior notice).
  • Law enforcement, government officials, or other third parties when:
    • we are compelled to do so by a subpoena, court order or similar legal procedure,
    •  we need to do so to comply with law or credit card association rules
    • we are cooperating with an ongoing law enforcement investigation,
    • we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity, or to investigate violations of our User Agreement.
  • Other third parties with your consent or direction to do so.

Please note that these third parties may be in other countries where the laws on processing personal information may be less stringent than in your country.

iMediaBank will not sell or rent any of your personal information to third parties in the normal course of doing business and only shares your personal information with third parties as described in this policy. 

If you open a iMediaBank account directly on a third party website or via a third party application, any information that you enter on that website or application (and not directly on a iMediaBank websites) will be shared with the owner of the third party website or application – and your information may be subject to their privacy policies.

How you can control our communications with you

You can control how we use your contact information to market our services by changing your preferences on the Notifications page. This page can be accessed by going to the Profile subtab under the "My Account" tab after you login to the iMediaBank website.

Log Files


As with most other websites, we collect and use the data contained in log files.  The information in the log files include  your IP (internet protocol) address, your ISP (internet service provider, such as AOL or Shaw Cable), the browser you used to visit our site (such as Internet Explorer or Firefox), the time you visited our site and which pages you visited throughout our site.

Information we collect 


We collect information to only for our services / product use. Not for resell or publish to public. We keep your information under a security server and delete after use. iMediaBank will not take any rights legal responsibility for any client's data. 

Cookies and Web Beacons


We do use cookies to store information, such as your personal preferences when you visit our site.  This could include only showing you a popup once in your visit, or the ability to login to some of our features, such as forums.


We also use third party advertisements on iMediaBank.com to support our site.  Some of these advertisers may use technology such as cookies and web beacons when they advertise on our site, which will also send these advertisers (such as Google through the Google AdSense program) information including your IP address, your ISP , the browser you used to visit our site, and in some cases, whether you have Flash installed.  This is generally used for geotargeting purposes (showing New York real estate ads to someone in New York, for example) or showing certain ads based on specific sites visited (such as showing cooking ads to someone who frequents cooking sites).


DoubleClick DART cookies


We also may use DART cookies for ad serving through Google’s DoubleClick, which places a cookie on your computer when you are browsing the web and visit a site using DoubleClick advertising (including some Google AdSense advertisements).  This cookie is used to serve ads specific to you and your interests (”interest based targeting”).  The ads served will be targeted based on your previous browsing history (For example, if you have been viewing sites about visiting Las Vegas, you may see Las Vegas hotel advertisements when viewing a non-related site, such as on a site about hockey).  DART uses “non personally identifiable information”.  It does NOT track personal information about you, such as your name, email address, physical address, telephone number, social security numbers, bank account numbers or credit card numbers.  You can opt-out of this ad serving on all sites using this advertising by visiting http://www.doubleclick.com/privacy/dart_adserving.aspx 


You can choose to disable or selectively turn off our cookies or third-party cookies in your browser settings, or by managing preferences in programs such as Norton Internet Security.  However, this can affect how you are able to interact with our site as well as other websites.  This could include the inability to login to services or programs, such as logging into forums or accounts.


Deleting cookies does not mean you are permanently opted out of any advertising program.  Unless you have settings that disallow cookies, the next time you visit a site running the advertisements, a new cookie will be added.
